IDEAS:

• Artículo 33 de la constitución del Ecuador, artículo base para encontrar fallas en la Ley De Apoyo Humanitario.
• La ley humanitaria en el artículo 21 plantea que el empleador puede notificar de forma unilateral al trabajador con el cronograma de vacaciones lo que sería inconstitucional ya que estaría vulnerando el inciso dos del artículo 326 de la constitución ya que se dice que los derechos laborales son irrenunciables e intangibles.
• El artículo 20 acerca de la baja de sueldos, estaría violando el artículo 328 de la Constitución, que establece que el pago de remuneraciones no podrá ser disminuido ni descontado, salvo con autorización expresa de la persona trabajadora (Benavides,2020)
• Para solucionar algún conflicto nos debemos basar en el art 326 inciso 10
• Art. 4.- Irrenunciabilidad de derechos.- Los derechos del trabajador son irrenunciables. Será nula toda estipulación en contrario.
• El artículo 19 de la Ley Humanitaria plantea un contrato especial, a través del cual la jornada laboral ordinaria puede ser de 20 a 40 horas semanales distribuidas en un máximo de seis días a la semana, vulnera la estabilidad laboral de las personas porque da espacio para que algunos empleadores cesen a los trabajadores y los vuelvan a contratar bajo la nueva modalidad.
• El empleador tiene obligaciones entre las cuales están pagar un sueldo digno a su trabajador.
• Las personas que sean desvinculadas serán beneficiadas con el bono de desempleo que existe en el Ecuador pero modificándolo para que la persona sea beneficiada por un plazo de un año 

Soluciones propuestas:

•  Buscar acuerdos a través de centros de arbitraje y mediación. Estas instancias son autorizadas por el Consejo de la Judicatura y existen unas 100 habilitadas en el país (Grijalva,2020)
• Sugerir a los propietarios de negocios que han arrendado locales con fines comerciales, negociar con los arrendadores para que el pago de dichas facturas se realice a plazos.
• Buscar una condonación de la deuda del seguro social a las personas que han sido afectadas directamente por la pandemia. (Personas de la tercera edad, personas desempleadas, contratadores, trabajadores públicos, personas que están poniendo en riesgo su vida por la pandemia)
• Introduccion:
  Currently, the world is experiencing a pandemic, which has not been experienced since 2014 with the Zika virus. Today, June 22, 2020, COVID-19 has claimed 412,00 victims worldwide and 5000 in Ecuador since its inception on December 1, 2019.
  
  
  This pandemic changes our lives in different aspects that may be very different, but today it has a very strong correlation; such as coexistence in the family nucleus or the measures imposed by the president.
  Confinamiento en Ecuador
  In Ecuador, confinement was forced to alliviate contagion, but all activity economic is also stoped, and the country is in a economic crisis, and the government try to back to the normality, but is very difficult and the president make a plan that is called Humanitarian  Law, that caused manifestations in many places of the country
  La ley humanitaria en Ecuador:
  
  
  The humanitarian law in Ecuador has generated much controversy since several articles of the constitution have been affected, in article twenty-one, it says that the employer can unilaterally notify the worker with the vacation schedule, another article that has caused controversy is the article twenty is spoken of the loss of wages but it would be bad since the article three hundred twenty-eight and several articles of the code of the worker, for that reason the mobilizations on the part of the workers unions of all the country were generated.
  Artículos afectados.
  This Humanitary law has some articles that goes against our constitution according to the opinion of some people like assemblymen and journalist.
  Some articles of our constitution that had been affected are: article 328 that establishes the payment of wages to workers, other affected articles is the number 326 point 2 that establishes the rights of the workers.
  For a probable solution we can base on article 326 point 10.
  
  
  
  
  Solutions 
  
  
  • Seek agreements through arbitration and mediation centers. These bodies are authorized by the Council of the Judiciary and there are about 100 enabled in the country.
  • Suggest that business owners who have leased premises for commercial purposes negotiate with landlords so that payment of such invoices is made in installments.
  • Seek social security debt forgiveness to people who have been directly affected by the pandemic. (Elderly, unemployed, hiring, public workers, people who are putting their lives at risk by the pandemic).
  • Persons who are disengaged will benefit from the unemployment bond that exists in Ecuador but modifying it so that the person is benefited for a period of one year
